Terms and Conditions: Elephant Island Tours

1. Booking and Confirmation

  • A booking is considered confirmed only after Elephant Island Tours (the “Company”) sends a written confirmation via Email or WhatsApp.
  • For multi-day tours, a deposit of 20% may be required. The remaining balance must be paid at the start of the tour or as agreed.

2. Cancellation and Refunds

  • Day Tours/Taxi: Cancellations made within 24 hours of the scheduled time may be subject to a cancellation fee.
  • All-Round Tours: Cancellations made less than 7 days before arrival are non-refundable (if a deposit was paid), as these involve pre-booked logistics.
  • No refunds will be given for “no-shows” or unused portions of a tour once it has commenced.

3. Transport and Taxi Services

  • The Company provides well-maintained, air-conditioned vehicles and professional English-speaking drivers.
  • The Company is not liable for delays caused by traffic, road construction, weather conditions, or mechanical breakdowns, though we will make every effort to provide a replacement vehicle promptly.

4. Hotel Booking Service

  • Elephant Island Tours acts as an agent only when booking hotels. We are not responsible for the quality of service, facilities, or any disputes arising at the hotel.
  • Guests must follow the specific check-in/check-out policies of the booked hotel.

5. Motorbike Rental

  • License: The renter must possess a valid International Driving Permit (IDP) or a temporary Sri Lankan driving license.
  • Responsibility: The renter is fully responsible for any damage to the motorbike, theft, or legal fines incurred during the rental period.
  • Safety: Helmets must be worn at all times. The Company is not liable for any accidents, injuries, or fatalities resulting from the use of the rented motorbike.

6. Limitation of Liability & Insurance

  • Personal Safety: While we prioritize your safety, Elephant Island Tours is not liable for any injury, illness, death, loss, or damage to personal property during tours, safaris, or transport.
  • Travel Insurance: It is a strict condition of booking that all guests have comprehensive travel insurance covering medical expenses, accidents, and trip cancellations.
  • Third-Party Activities: For activities like Safaris or Boat Rides, the Company acts as an intermediary. The rules and safety risks of the specific park or operator apply.

7. Force Majeure

  • The Company is not liable for changes or cancellations caused by “Force Majeure” (events beyond our control), including but not limited to natural disasters, pandemics, strikes, or government restrictions.

8. Governing Law

  • These terms are governed by the laws of the Democratic Socialist Republic of Sri Lanka. Any disputes shall be settled in the courts of Sri Lanka.
